JUDGMENT / ORDER

Hon'ble Chandra Dhari Singh,J.
Learned counsel appearing for the contemnor prays for and is permitted to delete paragraph 10 of the affidavit.
Sri I.K. Chaturvedi, advocate filed vakalatnama on behalf of opposite party Abhilash Chandra Trivedi along with affidavit filed on behalf of contemnor Abhilash Chandra Trivedi, in Court today is taken on record.
Heard Sri I.K. Chaturvedi, Advocate, appearing on behalf of contemnor-opposite party and perused the record.
The contemnor-opposite party has filed an affidavit sworn by him. In para-14 of the affidavit the contemnor-opposite party an unconditional apology has been given. The relevant extract of para-9 is reproduced as under:
"14. That at this state without advancing any defence in his support, the deponent tenders unconditional apology before this Hon'ble Court as well as learned Presiding Officer/learned C.J.M., Fatehpur with undertaking that in future he will extend full respect and honour to the learned Presiding Officer as well as other learned Judicial Officers of Sessions Division, Fatehpur where the deponent is practicing."
The opposite party-contemnor again tenders his unconditional apology with folded hands and prays that his unconditional apology may kindly be accepted.
In view of the unconditional apology tendered by the opposite party-contemnor is accepted. The notices issued against him hereby discharged. The contempt proceedings are dropped.
However, we are placing the contemnor Abhilash Chandra Trivedi under caution that in case, in future he commits any misconduct or any other act contemptuous on his part is reported to this Court, the Court will take serious view and proceed against him in accordance with law.
Accordingly, the contempt application is disposed of.
