By the order dated 17.08.2007, the contemnor, Arun Kumar Yadav, Advocate, Khaga, Fatehpur was convicted under Section 12 of the Contempt of Courts Act and sentenced to suffer simple imprisonment for one month and to pay a fine of Rs.2000/- and in default of payment of fine, to suffer further simple imprisonment for two weeks. The operation of the order was kept in abeyance for a period of 60 days to enable the contemnor to file an appeal, if so advised, before the Apex Court.
It appears that the contemnor opposite party preferred Criminal Appeal No. 1430 of 2010 before the Apex Court, which was dismissed by order dated May 29, 2013.
Office has placed the record of the case with report dated 07.12.2018 submitted by the Chief Judicial Magistrate, Fatehpur, disclosing that pursuant to the order passed by the Apex Court, the contemnor opposite party was taken into custody and after serving the sentence he has been released on 27.07.2013.
In view of the above, nothing further remains to be done in these proceedings. The record be consigned.
