Sri O.P. Misra, Advocate, filed an application on behalf of Kotak Mahindra Bank Limited and IFCI Ltd. claiming the payment in view of the order of learned single Judge in appeal. He further submitted that IDBI is also entitled for the claim.
Sri Anugar Khanna, Advocate, filed an application on behalf of PICUP claiming the payment in pursuance of the said order.
Sri Raj Nath Shukla, Advocate, submitted that in pursuance of the order in appeal the adjudication of claim has been made. The report relating to adjudication is 68 of 2010. He submitted that the dues shall be paid to the applicants on the basis of the adjudication after adjusting the amount already paid.
Sri O.P. Mishra, Advocate, and Sri Fahim Ahmad, Advocate, holding brief of Sri Anurag Khanna, Advocate submitted that there is no objection to the adjudication.
Let the Official Liquidator may pay the amount as per adjudication to the claimants by 15th January, 2011 after the adjustment of the amount already paid. The Official Liquidator is directed to send the copy of the adjudication to the concerned claimants within one month. It is made clear that it is not necessary to send the copy of adjudication to those claimants whose claims have already been rejected and have become final.
