In The High Court Of Judicature At ... vs The State Of Tamil Nadu

Madras High Court|17 February, 2017

JUDGMENT / ORDER

By consent, the Writ Petition is taken up for final disposal.
2.The petitioner would state that he was initially appointed as Watchman/Sweeper during the year 1985 on daily wage basis through Employment Exchange and posted in the Office of the Deputy Chief Inspector of Factories, Division-I, Coimbatore and he was ousted in the year 1993 for want of vacancy. The petitioner filed O.A.No.509 of 1994 on the before the Tamil Nadu Administrative Tribunal and got direction to the Heads of the Department to comprehensively examine the employment and requirement in an Office and Establishment under the control in terms of the relevant Government Orders and other consequential relief. The petitioner was reinstated in service on 10.07.1995. The petitioner would further aver that juniors to the petitioner viz., A.Ram, Rathinam, C.Thangavelu, R.Packirisamy and G.Balasubramanian were regularized in service with effect from 30.09.2002 in G.O.Ms.No.83 of the 1st respondent dated 30.09.2002 and the petitioner places reliance on G.O.Ms.No.11, Labour and Employment (E2) Department dated 15.02.2006 in and by which there was a direction to the same authority to appoint the petitioner on regular basis. On that basis, the petitioner was given regular appointment on 27.02.2006. The grievance expressed by the petitioner is that even after a positive direction, his service is yet to be regularised and he has, in this regard submitted series of representations and last such representation was on 20.04.2016 and since no orders have been passed, came forward to file this Writ Petition.
3. This Court heard the submissions of the learned counsel appearing for the petitioner and Mr.P.Senthilvel, learned Government Advocate, who accepts notice on behalf of the respondents.
4.Though the petitioner prays for larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the respondents to consider and dispose of the petitioner's representation dated 20.04.2016 on merits and in accordance with law and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
5.The Writ Petition is disposed of accordingly. No costs.
