Article 226 of the Constitution of India, praying for issuance of a Writ of mandamus to direct the respondents to consider the objections dated 25.02.2016 submitted by the petitioners and to provide the promotional opportunity to the serving Skilled Assistant in Town Panchayat Department with ITI qualification to the post of Overseer/Draughtsman without insisting the qualification of Diploma in Engineering while framing regular service Rules for Town Panchayat Engineering Services.

2. Heard the learned counsel appearing on either side.
3. All these petitioners are working now as Skilled Assistant Grade-II / Pipeline Fitter Grade-II in the respondent town panchayat on regular basis. As per the orders passed by this Court in W.A.No.1136 of 2013 etc., dated 13.03.2014, persons working in the post of Skilled Assistant Grade-II in Town Panchayat Services are eligible for promotion to the post of Overseer/Draughtsman and to that effect, the State Government have also framed draft rules for Town Panchayat Engineering Services. As per the said Rules, the post of Overseer/Draughtsman to be filled up by direct recruitment or by promotion and that the feeder category for the said post is prescribed as Work Inspector and Skilled Assistant Grade-II. However, for the purpose of promotion, the qualification is prescribed as Diploma in Civil Engineering.

Therefore, the grievance of the petitioners is that such qualification prescribed by the respondent by way of framing draft rules is depriving the rights of the petitioners, who have been working as Skilled Assistant Grade-II in Town Panchayat after completing ITI in their respective trade. Thus, it is submitted, though they have submitted their objections dated 25.02.2016 to the respondents by setting out the entire facts, till date, the same have not be considered. Hence, he pleaded, a direction may be given to the respondents to pass orders on the said objections of the petitioners.

In the light of the narrow prayer made by the petitioners, this Courts, without going into the merits of the matter, directs the respondents to consider the petitioners' objections dated 25.02.2016 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, with this direction, the writ petition is disposed of. No Costs.
