The petitioner along with one P.Saravanan were granted Anticipatory bail on 08.08.2017 for the offence under Section 294(b), 341, 323 and 506(ii) IPC, in Crl.M.P.No.11739 of 2017 in Crime No.1625 of 2017 by the Principal Sessions Judge, Court of Sessions at Chennai, subject to the condition that they shall report before the investigating officer daily at 10.30 a.m. for one month. The present petition has been filed by the petitioner to modify the said condition.
2. The learned counsel appearing for the petitioner would submit that the petitioner is the bread winner of his family and inview of the condition imposed, the petitioner is unable to do any work and earn for his family.
3. The learned Additional Public Prosecutor has not raised any serious objection.
4. Having regard to the fact that the petitioner is granted anticipatory bail for the offence under
Section 506(ii) IPC, I am of the considered view that the presence of the petitioner before the Inspector of Police, R8, Vadapalani Police Station, Chennai may not be necessary to complete the investigation. Therefore, I am inclined to relax the condition totally.
(i) Accordingly, the condition imposed on the petitioner that he shall report before the investigating officer daily at 10.30. a.m. for one month is totally relaxed.
(ii) All other conditions imposed in Crl.M.P.No.11739 of 2017 dated 29.08.2017 by the said court shall stand unaltered.
5. The Criminal Original Petition is ordered accordingly.
