This revision arises against the order of learned Judicial Magistrate I, Pollachi, passed in Crl.M.P.No.3420 of 2016 dated 28.09.2016.
2. Petitioner is arrayed as an accused in Crime No.375 of 2015 on the file of respondent for offence u/s.302 IPC. Petitioner filed Crl.M.P.No.3420 of 2016 on the file of learned Judicial Magistrate I, Pollachi, u/s.173(8) Cr.P.C. seeking further investigation. Court below, under the impugned order, dismissed such petition. Hence, this revision.
3. Heard learned counsel for petitioner and learned Government Advocate [Crl.side] for respondent.
4. This revision is preferred by an accused, who has filed a petition u/s.173(8) Cr.P.C, which has been dismissed. Court below is right in dismissing the petition as such a petition would not lie.
