JUDGMENT / ORDER

The petitioner filed an application before Insolvency Court to implead her as a party to the proceeding, taking into account the purchase of the petition scheduled property by her. The learned Judge having found that the purchase was after a period of 12 years since initiation of Insolvency Petition, dismissed the application. The order dated 3 November 2011 in I.A.No.300 of 2011 in I.P.No.27 of 1998 on the file of the I Additional Subordinate Court, Coimbatore is under challenge in this civil revision petition.

When the civil revision petition was taken up for hearing, learned counsel for the respondents by producing a copy of the registered document no.5669 of 2015 on the file of the Sub-Registrar, Coimbatore, submitted that during the currency of this civil revision petition, the petitioner assigned the property to a third party and she is no longer the owner of the property.
3. The petitioner filed the application on the strength of a sale deed in her favour. According to the petitioner, she is a bona fide purchaser. However, the fact remains that she sold the property subsequently and as such, the petitioner is not having any right in respect of the scheduled property. I am therefore, of the view that there is no need for a factual adjudication of the matter.
The civil revision petition is dismissed on account of subsequent events. No costs. Consequently, connected miscellaneous petition is closed.
