The petitioner school has been established in the year 1944 as an Aided School. There are three teaching posts sanctioned which include one Headmaster, one B.T. Assistant and one Secondary Grade Teacher.
2. One Ms. S. Chitra, working as B.T. Assisant Headmaster passed away on 23.12.2014. Therefore, in the resultant vacancy, the seniormost Secondary Grade Teacher, Thiru S. Loganathan was promoted as Headmaster with effect from 02.09.2015 and his promotion has been duly approved by the Department as per the proceedings of the 2nd respondent dated 11.09.2015. Pursuant to the promotion of Thiru S. Loganathan to the post of Headmster, the post of Secondary Grade Teacher, which was occupied by him became vacant with effect from 02.09.2015. Hence, the petitioner school submitted an application to the 2nd respondent through the 3rd respondent on 30.11.2015 seeking permission to fill up the post of Secondary Grade Teacher. The 3rd respondent had also forwarded the proposal to the 2nd respondent by communication dated 15.02.2016 with a recommendation to pass appropriate orders, in regard thereto. However, the 2nd respondent has not, so far, passed any orders granting permission to fill up the post of Secondary Grade Teacher, which is lying vacant from 02.09.2015. Since no decision has been taken by the 2nd respondent, the petitioner has come before this Court.
3. Heard Mr.G. Sankaran, learned counsel for the petitioner and Mr.T.M. Pappiah, learned Special Government Pleader appearing for the respondents.
4. Since the 3rd respondent has sent the proposal to the 2nd respondent by communication dated 15.02.2016, appropriate orders have to be passed by the 2nd respondent. Therefore, the writ petition is disposed of directing the 2nd respondent to pass appropriate orders on the proposal sent by the 3rd respondent, by communication dated 15.02.2016, within a period of four weeks from the date of receipt of a copy of this order.
