(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this public interest litigation, the writ-petitioner has prayed for a direction upon the respondents not to transfer the building of Referral Hospital and Public Health Centre at present situated at Kadi to Kundal, which is situated 2 kms. away from Kadi.
After hearing the learned counsel for the petitioner and after going through the materials on record, we find that a new Referral Hospital is being constructed in village Kundal which is 2 kms. from Kadi. There is no justification of entertaining this application. It is needless to mention that the persons residing in Kadi will be entitled to get the benefit in a new building whereas at present in the old building the said Health Center is being run.
The application is thus dismissed.
