1. Rule.
Mr. K.L. Pandya learned APP waives service of rule on behalf of the State.
2. The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to take care of his mother.
3. The medical papers are not produced and the sickness mentioned is as that of B.P., which cannot be said to be a sickness, where the presence of the applicant can be said to be indispensable. Under the circumstances, the discretion does not deserve to be exercised, and therefore, the application is not granted. Rule is discharged.
