Heard counsel for the petitioner and the learned standing counsel for respondent Nos. 1 to 4.
The petitioner has allegedly filed an application for exchange of his land bearing plot No. 267 area 1.1030 hectare situated in village Sadi Bankati, Tappa - 84, Pargana - Kantit, Tehsil - Sadar, district Mirzapur with that of the land of Gaon Sabha under Section 101Kha read with Rule 102 of the U.P. Revenue Code, before Sub- Divisional Magistrate, Sadar, Mirzapur on 16.8.2018.
Learned counsel for the petitioner states that the application has been assigned Case No. D201816530006154. The sole grievance urged in the instant petition is that no action is being taken on the said application and accordingly the petitioner has prayed for a direction to the Sub-Divisional Magistrate to decide the said application by a speaking order.
Learned standing counsel very fairly states that the application would be decided within such time as may be directed by this Court.
Accordingly, without expressing any opinion on merits, the instant petition is disposed of by directing respondent No. 3 to decide the application registered as Case No. D201816530006154, in accordance with law, expeditiously, preferably within a period of four months from the date of receipt of certified copy of this order.
