Heard learned counsel for the petitioner and the learned AGA appearing for the State respondents.
The petitioner through the present petition have invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India prying for certiorari quashing the impugned F.I.R. dated 13.10.2010, relating to Case Crime No.530 of 2009 under Section 409 I.P.C. Police Station Tarya Sujan, Distict Kushinagar. The ancillary prayer is to issue a writ of mandamus commanding the respondents not to arrest the petitioner in the aforesaid crime number pendentilite the writ petition.
A perusal of the impugned FIR discloses commission of cognizable offence. Hence, the question of quashing the F.I.R. does not arise. The writ petition in this regard is dismissed with a direction to the Court concerned that the bail prayer of the petitioner will be considered and disposed of expeditiously.
