Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents.
Sri Manoj Kumar Gupta, learned counsel holding brief of Sri M.N. Singh, learned counsel states that he has filed his impleadment application in the office on 9.9.2021, the same is not on record.
Office is directed to trace and place the same on record.
Present petition has been filed for directing the Assistant Registrar, Firms Societies and Chits Gorakhpur Region, Gorakhpur (respondent No. 3) to decide the dispute of the Committee of the Management of the Society namely "Anjuman Islamiya, Village & Post- Deoria Meer, District- Deoria" in pursuance of Hon'ble High Court order dated 13.08.2019 passed in Writ-C No. 26462 of 2019.
Pursuant to the order of this Court, learned Standing Counsel has produced a copy of the instruction dated 20.9.2021, which are taken on record. Along with instructions, a copy of the order dated 20.9.2021 has been annexed. Learned Standing Counsel has also supplied a copy of the instructions to learned counsel for the petitioner.
Learned counsel for the petitioner admits that in view of the aforesaid order dated 20.9.2021, present petition has become infructuous as the cause of action no longer survives, therefore, he may be permitted to withdrawn the present petition.
Accordingly, present petition stands dismissed as withdrawn.
