Heard learned counsel for the petitioner, Sri Rajendra Kumar Mishra, learned counsel for respondent no.3 and learned AGA for the State.
The argument advanced by the counsel for the petitioner is to the effect that the F.I.R. has been registered against the husband of the petitioner Shamshad, who died 17 years ago. The petitioner is the widow of late Shamshad in whose name the aforesaid connection was existing.
According to Sri Mishra, learned counsel appearing for Power Corporation the present petitioner i.e. widow of registered connection holder has been continuously using the electricity by unauthorisedly connecting the permanent disconnected connection and earlier also action was taken against the petitioner and this is second/repeated unauthorised connection made by the present petitioner.
In view of the above, we are not inclined to interfere in the matter. The writ petition is accordingly, dismissed. However, it would be open to the petitioner to take appropriate recourse under the provisions of Electricity Act as may be admissible.
