Heard Sri Syed Imran Ibrahim, learned counsel for the petitioners, Sri Pradeep Kumar Shukla, learned counsel for the caveator, Sri A.R. Chaurasia, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 15.8.2018 registered as case crime no.967 of 2018 under sections 406, 420, 467, 468, 471 I.P.C., police station Kankarkheda, District Meerut.
Learned counsel for the petitioners submits that the dispute between the parties is in respect to a property.
Learned A.G.A. as well as learned counsel for the caveator opposed the prayer for quashing. Learned counsel for the caveator pointed out that the petitioner was also involved in a case under section 307 IPC which was lodged for the assault by the petitioners on the husband of the respondent no. 3.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
