Heard Sri Gaurav Singh holding brief of Sri Awadhesh Kumar Srivastava, learned counsel for the applicant, Sri Shadab Ali, learned counsel for the complainant, Sri Ashish Pandey, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant is languishing in jail since 28.1.2016, 35 dates have been fixed in the matter and NBW have also been issued against the prosecution witnesses who are delaying the trial.
Learned counsel for the complainant vehemently opposed the prayer for bail and has submitted that the applicant is the main shooter, the statement of PW1 has been completed and PW2 cross-examination is going on. He undertakes that prosecution witnesses would appear before the trial Court and the trial would not be delayed.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant-Imran alias Raju involved in Case Crime No.31 of 2016, under Section 302 I.P.C., Police Station Ganj, District Rampur.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
Applicant is directed to produce a certified copy of this order before the trial Court concerned for its compliance.
