The application filed by the petitioner u/S 152 of CPC for correcting certain mistake in judgment and decree of the Appellate Court dated 19.7.1995 is stated to be pending. The petitioner has prayed for a direction to the Appellate Court to decide the same expeditiously and for a further direction restraining defendant-respondents from interfering in his possession.
A perusal of the order sheet of Misc. Case No. 1 of 2003 reveals that both the parties are regularly appearing in the case, but the Appellate Court has been adjourning the case for no rhyme or reason.
Accordingly, the instant petition is disposed of with direction to the court below to decide Misc. Case No. 1 of 2003 without further delay, provided there is no legal impediment.
