Heard learned counsel for the applicant.
By means of this transfer application, the applicant seeks transfer of a civil appeal pending before the Additional District and Sessions Judge, Court No. 1, Azamgarh to some other court in the same district. The applicant is the appellant in the said appeal. The only averment in support of the transfer application is to be found in paragraph 5 of the affidavit which is extracted below:-
"5. That is is relevant to mention here that on a day the opposite party no. 1 namely Mahfujurrahman said before the friend of applicant that he is influencing the court and in the aforesaid pending appeal he has got order in his favour from the Additional District & Sessions Judge, Court No. 1, Azamgarh. "
The aforesaid allegations is an extremely vague allegation which does not mention either the place, date or time when the said statement is alleged to have been made before the friend of the appellant. For the same reason, I do not find any merit in the transfer application which is accordingly, dismissed.
