JUDGMENT / ORDER

The issue in this writ petition is covered by the decision of this Court in Shan C.T. v. State of Kerala [2010 (3) KLT 413]. The learned counsel for the petitioner submits that the sand seized is only ordinary sand and not river sand. Ext.P3 is a representation filed by the petitioner requesting the second respondent-Revenue Divisional Officer to take sample of the sand seized for despatching the same for the report of the fourth respondent.
2. The second respondent shall take sample of the sand seized and despatch the same to the fourth respondent, as requested for in Ext.P3, within a period of one week. The fourth respondent shall send its report, based on such sample, within a period of three weeks. The second respondent, based on the above report, shall finalise the proceedings within a period of two weeks thereafter. The writ petition is disposed of as above.
