COMMON ORDER:
These three writ petitions have been filed questioning separate but identical orders passed by respondent No.2, whereby he has suspended the petitioners’ fair price shop authorisations on the purported ground that they have been distributing only 09 kgs out of 10 kgs per person of free rice to the cyclone victims.
This Court by interim orders passed on 17.11.2014 while prima facie observing that respondent No.2 has blatantly abused his public office by suspending the petitioners’ authorisations on flimsy and unfounded grounds, directed the said respondent to show-cause why disciplinary proceedings shall not be directed to be initiated against him.
Today, Sri K.Surya Rao, the incumbent of respondent No.2, is personally present. He has placed before the Court separate but similar orders passed by him on 24.11.2014, wherein he has restored the petitioners’ fair price shop authorisations. Respondent No.2 while profusely apologising for the serious mistake committed by him in suspending the petitioners’ authorisations, pleaded for the Court’s pardon and assured that he will not repeat such conduct in future. He has also stated that as he is satisfied that the allegations made against the petitioners are unfounded, he has already dropped the proceedings and he will not proceed further against them with respect to the allegations on which their authorisations have been suspended.
Having regard to the remorse expressed by respondent No.2 and the remedial steps taken by him, the writ petitions are closed with a warning to him not to repeat such conduct in future.
As a sequel to disposal of the writ petitions, the pending interlocutory applications shall stand disposed of as infructuous.
