Heard learned counsel for the petitioners as well as Sri Abhishek Shukla, Standing Counsel appearing for the respondents no. 1 to 3 and Sri Diwakar Singh, learned counsel appearing for the respondent no.4.
Present writ petition has been filed seeking quashing of the order dated 28.9.2018 passed by the respondent no. 3. A further prayer in the nature of mandamus commanding the respondents no. 2 and 3 to do demarcation of the land of the petitioners in accordance with law has also been made.
By means of the order dated 28.9.2018 the case filed under Section 24 of the U.P. Revenue Code, 2006 has been dismissed observing that nobody has appeared on behalf of the petitioners.
The petitioners have a remedy against the aforesaid order by way of filing recall application or by filing appeal under Section 24 (4) of the U.P. Revenue Code, 2006.
In such view of the matter, I am not inclined to entertain the present writ petition.
This writ petition is, accordingly, dismissed on the ground of alternative remedy available to the petitioners.
Office is directed to return the certified copy of the order to the learned counsel for the petitioners within two days after keeping a photo copy of the same on record.
