Heard learned counsel for the applicants, learned A.G.A. and perused the record.
Learned counsel for the applicant contended that the applicant has been falsely implicated in the present case and he has also contended that on perusal of the FIR, general role has been assigned by gun-shot against all the named accused and he has also submitted that the applicant has never demanded any dowry. It is also submitted that three witness P.W.-1 first informant, P.W.-2 (independent witness) and P.W.-3 mother of the deceased examined in trial court but these witnesses did not support the prosecution story.
Learned counsel for the applicant further contended that some unknown persons entered into the house and shot-dead the deceased Shabana but the father of the deceased falsely lodged the FIR against the applicant.
He further submits that there are no chances of applicants fleeing away from the judicial process or tampering with the prosecution evidence, and are in jail since 09.01.2019.
Learned A.G.A. has vehemently opposed the prayer of bail application submitting that allegations against the applicants are serious in nature, and therefore, bail may not be granted.
Considering the facts and circumstances of this case, the bail application of the applicant is hereby rejected.
However, it is directed that the trial court shall make every endeavor to conclude the trial within three months without giving any unnecessary adjournment.
