Heard Shri Manoj Kumar, learned counsel for the petitioner; Shri Apurva Hajela, learned Standing Counsel for the State respondents and Shri Amresh Singh, learned counsel for the Gaon Sabha.
The petitioner is before this Court assailing the order dated 26.11.2010 passed by the Tehsildar, Meerganj, District Bareilly in proceeding under Section 122B of UP ZA & LR Act and for direction to the respondents not to dispossess him from the land in dispute and not to recover any cost from him.
At the very outset, Shri Apurva Hajela, learned Standing Counsel as well as Shri Amresh Singh, appearing for the respondents have raised preliminary objection regarding maintainability of the writ petition on the ground of delay and laches.
Once the objection has been raised then the Court has proceeded to examine the record in question as well as the report of the Stamp Reporter dated 26.10.2018 wherein it has been stated that the present writ petition has been filed beyond period of seven years and 241 days after lapse of period of limitation.
Learned counsel for the petitioner has requested for condonation of this delay.
The petitioner has not sufficiently explained the delay in filing the writ petition and therefore, the request for condonation of delay is declined.
Accordingly, this writ petition is dismissed on the ground of delay and laches.
