Heard Sri Ravindra Pandey, learned Advocate, holding brief of Sri Satyam Narayan, learned counsel for the petitioners, Sri Tabrez Ahmad, learned counsel appearing for the private respondent no.3, Sri Gaurav Pratap Singh, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
This writ petition has been filed by the petitioner with a prayer to quash the impugned FIR dated 28.9.2018, registered as case crime No.1518 of 2018, under Sections 498A, 376, 511, 354Kha, 377, 323, 506, 307 I.P.C. and 3/4 D.P.Act, Police Station Lisarigate, District Meerut. This matter being matrimonial in nature was referred to Mediation & Conciliation Centre of this Court by order dated 29.10.2018 Learned counsel for the respondent no.3 submits that the mediation between the parties has failed. The report of the Mediation and Conciliation Centre dated 12.2.2019 is available on record.
From the perusal of the interim order dated 29.10.2018 passed by a Coordinate Bench of this Court it appears that this Court had stayed the arrest of the petitioners till submission of police report under Section 173 (2) Cr.P.C. and since the investigation has not been completed till date, we dispose of this writ petition with the direction that the petitioners shall not be arrested till submission of police report under Section 173 (2) Cr. P. C. The petitioners shall file a certified copy of this order within two weeks' from today before the SSP concerned, who shall look into the matter and ensure that the investigation in the above mentioned case is completed expeditiously preferably within six weeks from the date of production of certified copy of this order.
With the aforesaid direction, this petition is finally disposed of.
Learned AGA shall communicate this order to the concerned authorities concerned.
