The writ petition is being filed seeking following relief:
" issue a writ , order or direction in the nature of mandamus, commanding the respondents specially the respondent nos. 2,3 and 4 to take action, over the land in question, situated in Village Maant Raja, Tahsil Maant, District Mathura was declared as Enemy Property and recorded as Government Property in the revenue record."
Perusal of the records reveals that the petitioner wants rights as have been granted to others regarding the land in question.
Learned Standing Counsel points out that the land is recorded under Class-I A, meaning that the recorded tenureholder is its Bhoomidhar. Therefore, in essence the petitioner seeks declaration as Bhoomidhar.
For this purpose the petitioner has an alternative remedy of suit for declaration which in case so advised, the petitioner may avail.
Subject to the above the writ petition is dismissed.
