Heard Ms. Alka Rani, learned counsel for the petitioners.
The petitioners are running coal furnace and they are having valid license to run the same. They applied for the renewal of their license for the year 2018-19 but no decision thereof has been taken.
Learned counsel for the petitioners submits that now the petitioners are entitle for the renewal of their license for the year 2019-20 also.
The license to run coal furnace is granted under the provisions of Uttar Pradesh Koyla Bhatti Ki Staphna Evam Viniyaman Niyamawali, 2010 which have been framed in exercise of powers under Section 51-A of the Indian Forest Act, 1927.
The aforesaid Niyamawali provides for the renewal of coal furnace license by the Prabhagiya Van Adhikari. The petitioners' application and representations are pending consideration before him.
In view of the aforesaid facts and circumstances, we dispose off the writ petition with liberty to the petitioners to submit a comprehensive representation and separate applications for the renewal of their licenses for the year 2019-20 in addition to their earlier applications for renewal of their licenses for the year 2018-19 to the respondent No.2 or the Prabhagiya Van Adhikari, as the case may be, within a period of two weeks from today.
In case any such applications are filed, the authority concerned shall consider and pass appropriate orders in accordance with law most expeditiously, preferably within a period of six weeks from the date of submission of such applications.
