JUDGMENT / ORDER

Court No. - 36
Case :- WRIT - A No. - 19170 of 2019 Petitioner :- Ikbal Haider Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Mohammad Umar Khan Counsel for Respondent :- C.S.C.
Hon'ble Mahesh Chandra Tripathi,J.
Heard learned counsel for the parties.
By means of present writ petition, the petitioner has prayed for direction to the respondent no.2 to consider his claim for promotion on the post of Head Constable (Civil Police) within stipulated time.
Learned counsel for the petitioner states that so far as the grievance of the petitioner is concerned, he has already filed a representation dated 1.10.2019 before the respondent no.2 for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated 1.10.2019 may be considered by the appropriate authority.
Learned counsel for the respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of with liberty to the petitioner to file fresh representation along with certified copy of this order before the competent authority, which is stated to be respondent No.2, who may consider the representation filed by the petitioner and decide the same in accordance with law, expeditiously and preferably within a period of six weeks from the date of receipt of the representation.
