Iftkhar Ahmad vs Additional District Judge/Ex. ...

High Court Of Judicature at Allahabad|01 March, 2012

JUDGMENT / ORDER

The sole relief pressed for by learned counsel for the petitioner at the time of hearing of this petition is that SCC Revision No.13 of 2010 filed by the tenants-respondents against the judgment and order dated 25th February, 2010 passed by the Judge, Court of Small Causes by which the suit filed by the landlord-petitioner was decreed, be decided expeditiously.
It is the submission of the learned counsel for the petitioner that though the Revision was filed in 2010 but for one reason or the other, it is being adjourned. It is his submission that great prejudice is being caused to the petitioner on account of delay in disposal of the Revision. In this connection, learned counsel for the petitioner has also placed before the Court the order-sheet of the case.
In view of the nature of the relief claimed by the petitioner and the order that is proposed to be passed, it is not necessary to issue notices to respondent nos. 2/1 to 2/5.
On a consideration of the submissions advanced by learned counsel for the petitioner, in view of the averments made in the writ petition and on perusal of the order-sheet, this petition is disposed of with a direction to the Revisional Court to decide SCC Revision No.13 of 2010 (Bashir Ahmad (since deceased) & Ors. Vs. Iftkhar) expeditiously, without granting any unnecessary adjournment to any of the parties.
It is made clear that the Court has not adjudicated upon the merits of the case which shall be examined by the Revisional Court in accordance with law.
