JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE C.L. SONI) Learned advocate for the applicant has stated that the entire amount awarded by the Tribunal with cost and interest has been deposited. Mr.P.J.Patel appears for the claimants.
We have heard the learned advocates for the contesting parties. We are of the opinion that out of the amount deposited with the Tribunal, if 20% of the amount is permitted to be withdrawn by the claimants, interest of justice would be met. Accordingly, out of the entire amount deposited by the applicant, the claimants shall be permitted to withdraw 20% of the amount instead of 30% as directed by the Tribunal. Rest of the amount deposited with the Tribunal shall remain in fixed deposit as directed by the Tribunal initially for a period of five years to be renewed from time to time till the main appeal is finally heard and decided. We do not disturb rest of the directions of the Tribunal. This application is allowed to the aforesaid extent. Rule is made absolute accordingly.
