(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Pursuant to order dated 13.12.2011, the applicant-Insurance Company has deposited sum of Rs.19,70,336.00 before the Claims Tribunal. Out of the said amount, 80% thereof shall be deposited in any Nationalized Bank in Fixed Deposits, initially for a period of five years, to be renewed from time to time, till the final disposal of the appeals. Such deposits shall be in proportion of the disbursement ordered by the Claims Tribunal in its impugned order dated 22.11.2010 and shall be subject to the conditions imposed therein. It is clarified that the claimants will be entitled to receive interest accruing on such deposits.
Remaining 20% of the amount shall be paid over to the claimants in proportion of disbursement ordered by the Claims Tribunal in the said order.
With these directions, this Civil Application is disposed of. Rule is made absolute.
