ORDER IN FIRST APEAL:
Having considered the submissions advanced by learned advocate for the appellant-Insurance Company so also considering the impugned judgment and award dated 03.07.2012 rendered by the Tribunal, it appears that the appeals deserve consideration and hence, Admitted.
ORDER IN CIVIL APPLICATION:
Learned Advocate Mr. Ajay R. Mehta for the applicant-appellant submitted that they have already deposited the 50% of the awarded amount before the trial Court. He further submitted that they are ready to deposit the remaining 50% awarded amount along with the proportionate costs and interest before the tribunal before the returnable date.
Having considered the submissions advanced by learned advocate for the applicant-Insurance Company so also considering the impugned judgment and award dated 03.07.2012 rendered by the Tribunal, RULE returnable on 21 st January, 2013. In the meanwhile, there shall be ad-interim stay in terms of para-6(i) on the condition that on or before returnable date, the applicant Insurance Company shall deposit the remaining 50% awarded amount along with the proportionate costs and interest with the concerned claim Tribunal.
