Heard learned counsel for the applicant and learned AGA for the State.
This application under Section 482 Cr.P.C. has been filed to quash the entire proceedings of Case Crime No.0151, 2018, Charge Sheet dated 01.10.2018, under Sections 147, 149, 341,504, 506 I.P.C., Police Station Kotwali, District Moradabad.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
This Court cannot go into the merits of allegations at this stage.
It is open for the applicant to move discharge application through counsel before the court below within a period of one month from today. If such an application is filed the same shall be decided by the Court below within a period of two months thereafter.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid direction, application stands disposed of.
