The present application under section 482 Cr.P.C. has been filed seeking to quash the entire proceedings of Criminal Case No. 1660 of 2018/charge sheet dated 14.07.2018 State Versus Rayeesh and others (arising out of case crime no. 0086 of 2018 under Sections 147, 325, 452, 336, 323, 504, 506 I.P.C. Police Station Bhawaniganj, District Siddharth Nagar, cognizance order dated 30.11.2018 as well as non-bailable warrant dated 7.1.2021 passed by Learned Judicial Magistrate Court no. 1, Bansi District Siddharth Nagar.
Learned counsel for the applicant, at the very outset, fairly submits that the necessary ingredients for invocation of the powers under section 482 Cr.P.C. have not been made out in the facts of the case and accordingly, he does not wish to press the reliefs as prayed for in the present application.
Learned counsel for the applicants states that the applicants would submit to the jurisdiction of the court below and seek recall of the order dated 7.1.2021 in terms of which non- bailable warrants have been issued.
Needless to say, in case any such application is moved, the court below is expected to consider the same and decide the same in accordance with law.
Subject to the aforesaid observation, the application stands disposed of.
