On 16.1.2012, the OL has filed a report dated 13.1.2012, copies whereof were served to the learned advocates for the secured creditors, i.e. Mr. Bhagat and Ms. Lodha, learned advocates. So as to enable the learned advocates for the secured creditors to examine the details mentioned in the report, time was granted until today, i.e. 18.1.2012.
Today, when the matter is called out and taken up for hearing, Mr. Bhagat, learned advocate has made submissions with reference to the said report dated 13.1.2012.
Ms.
Lodha, learned advocate has not attended the hearing today. In the first call, when the matter was taken up for hearing, Ms. Lodha was not present. Therefore, so as to enable her to attend the hearing, a pass over was granted. Even in second call, Ms. Lodha has not attended the hearing. Any request on her behalf for pass over or adjournment is not made either in first call or in second call.
As a last chance, the hearing is adjourned, despite objections raised by Mr. Bhagat, learned advocate for the applicant-bank, so as to enable Ms. Lodha to make submissions with regard to the said report dated 13.1.2012, to 24.1.2012. If learned advocate does not remain present or is not in position to make submissions on the next date of hearing, appropriate orders will be passed taking into account submissions made by Mr. Bhagat.
