ORDER IN APPEAL:
Pursuant to the order dated 28/08/2012 Notice for final disposal was ordered to be issued qua respondent no.3 herein. Despite the fact that he is served with the notice, none appeared for him.
In above view of the matter, considering the submissions advanced by Ms. Bhatt learned advocate for the appellant-Insurance Company so also considering the impugned judgment and award rendered by the Tribunal, the appeal is ADMITTED.
ORDER IN CIVIL APPLICATION:
Having considered the submissions by Ms. Bhatt learned advocate for the applicant-appellant Insurance Company so also considering the impugned judgment and award rendered by the Tribunal, Rule returnable on 7th November, 2012. In the meanwhile, there shall be ad-interim stay in terms of Para-4(A) on the conditions that on or before returnable date, the applicant-Insurance Company shall deposit the entire awarded amount together with interest and proportionate costs with the concerned Claim Tribunal.
