ORDER IN CIVIL APPLICATION:
1. Heard learned advocates for the parties. Rule Mr. Hiren Modi learned advocate appears and waives service of rule for respondent nos.1 to 4.
2. Learned advocate for the applicant-appellant submits that the amount of Rs.5,29,391/- has already been deposited by the applicant-appellant and so further order for disbursement of the amount is required to be passed.
Compensation, Labour Court, Nadiad is directed to invest 70% of the total amount deposited, with any nationalised Bank in cumulative Fixed Deposit initially for a period of 3 years in the name of the claimant(s) and such investment shall be renewed from time to time until the appeal is finally disposed of. Rest of the 30% of the deposited amount be disbursed to the original claimant(s) by A/c. Payee cheque on proper verification. The FDR(s) shall be retained by the Nazir of Workmen's Compensation.
Rule is made absolutely.
