Vidhi J. Bhatt, learned advocate for the applicant submitted that inspite of all efforts made by the applicant, Rule issued by this Court in Civil Application Nos. 11928 to 11933 of 2012 has remained unserved upon respondent No. 2 herein. Hence, Present Civil Applications have been filed by the applicant under O. 5 R. 20 of the Civil Procedure Code, 1908 for service to the unserved respondent No. 2 by way of substituted service.
2. Perused the affidavit dated 26/11/2012, filed by one Shri Jagdish Rohra, authorized by the applicant - insurance company to serve the notice to the respondents. It appears that, before the tribunal, present respondent No. 2 has been duly served and he has engaged the advocate for his defence.
3. In above view of the matter, present Civil Applications are partly allowed. On supplying the exact address by the learned advocate for the applicant, the office is directed to serve respondent No. 2 by way of substituted service, under O. 5 Rule 20 of the Civil Procedure Code, 1908, through affixing at the last known address of respondent No.2. The returnable date is fixed to 22nd February 2013.
3.1 On the request made by the learned advocate for the applicant, prayer Para 6(C) of the Civil Applications is also granted.
4. The present Civil Applications are accordingly disposed of.
