49 out of 52 claim petitions arising out of the same accident are pending on the file of the Motor Accidents Claims Tribunal, Ernakulam. It is only proper that the other three claim petitions are also transferred to the Motor Accidents Claims Tribunal, Ernakulam. A joint trial of all the claim petitions may be necessary to render a finding on negligence and also the extent of liability of the insurer. Hence OP (M.V) Nos.408/2011, 402/2011 & 407/2011 respectively from the file of the Motor Accidents Claims Tribunal, Muvattupuzha are transferred to the Motor Accidents Claims Tribual, Ernakulam. The transferee court shall issue notice to the parties and take the proceedings to a logical end. The Transfer Petitions are disposed of.
