2. Though served, no one appears for the respondents.

Learned Counsel for the petitioner Mr. Udayan Vyas has submitted that on the strength of the certified copy of the Rojnama, even the suit of the plaintiffs came to be dismissed for want of prosecution, was restored and subsequently the Suit being Regular Civil Suit No.35/1991 was decreed on 31.03.2000.

It is submitted that the only remedy available to the petitioners / defendants would be lost if the delay is not condoned.
