The petitioner who is a villager contends that if an open meeting had taken place he would have participated in it and had, thereafter, objected to the allotment made in favour of the respondent no. 6. When the Tehsildar on that day turned down the objection of the petitioner, an approval was given to the allotment made in favour of the respondent no. 6. The petitioner, thereafter, filed an appeal.
The appeal was accompanied by an application for staying the approval/allotment made in favour of the respondent no. 6. When this application for staying the allotment was rejected, the petitioner filed the instant writ petition.
I have heard the learned counsel for petitioner, learned Standing Counsel and the counsel for the Gaon Sabha.
After the stay application was rejected it has been stated by the learned Standing Counsel dates were being fixed in the Appeal and the Appeal would be decided expeditiously.
It is, therefore, directed that since the Appeal itself has been filed in the month of May, 2019, and proceedings were initiated thereafter, the Appeal itself be decided within a period of one month from the date of production of a certified copy of this order, unless there is any legal impediment.
The allotment made in favour of the respondent no. 6 shall be subject to the decision of the appeal.
The writ petition is disposed of.
