ORDER:
This Civil Revision Petition arises out of order dated 25-11-2013 in I.A.No.1046 of 203 in O.S.No.352 of 2008 on the file of the learned VIII Additional Senior Civil Judge, Ranga Reddy District at L.B. Nagar, Hyderabad.
By the above mentioned order, the application filed by the petitioner/defendant No.1 for reopening the case for adducing the evidence of the defendants has been dismissed.
Though notice has been served on respondent No.1/plaintiff, no one entered appearance.
Sri K.K. Chakravarthy, learned Counsel for the petitioner/defendant No.1 submitted that no doubt his client was not diligent in pursuing the case, but he may be given one opportunity to adduce his side evidence. He has also submitted that on the same day on which the evidence is adduced, the petitioner’s counsel will argue the case also.
Though this Court is not satisfied with the conduct of the petitioner in not availing the repeated opportunities offered by the lower Court, considering the fact that respondent No.1/plaintiff has not opposed this revision petition, the Civil Revision Petition is allowed on payment of costs imposed by the lower Court on 6-6-2013 and 15-7-2013 within one week from the date of receipt of this order. The lower Court shall post the case for the evidence of the petitioner on a specific date. The petitioner shall not seek any adjournment for adducing evidence. The lower Court shall record the evidence of the petitioner on the day on which the case is posted and hear the arguments of both the parties immediately.
As a sequel to the disposal of the Civil Revision Petition, CRPMP No.1090 of 2014 filed for interim relief is disposed of as infructuous.
