THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.22419 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Transport (AP) appearing for respondent No.1 and Sri K.Satyanarayana Murthy, learned standing counsel for APSRTC., appearing for the respondents 2 to 4.
This writ petition is filed seeking to issue a writ of mandamus, declaring the order of dismissal issued in Order No.M1/475(04)/2013-MNGL, dated 11-3-2014 by the Depot Manager, Mangalagiri as illegal and in violation of the principles of natural justice apart from being harsh and highly disproportionate to the charge alleged against the petitioner as on that day he did not drive any vehicle under the influence of liquor.
The petitioner submits that a departmental enquiry was conducted against the petitioner on the charge that he was driving the vehicle under the influence of liquor and he was suspended. In the enquiry, he was found guilty and on receiving the enquiry report, he was removed from service by the disciplinary authority. Thereafter, the petitioner preferred an appeal on 15-
5-2014, which has not been disposed of.
It is submitted on behalf of the petitioner that the circular instructions have not been followed in initiating the disciplinary action against the petitioner and he was unnecessarily removed from service and that his appeal has to be heard expeditiously.
In the aforesaid circumstances, the third respondent- appellate authority is directed to hear and dispose of the appeal, within a period of two weeks from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
