PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to dispose of the statutory appeal preferred by the petitioner on 30.12.2008 against the order of the second respondent made in Na.Ka.No.291297/2008/A4, dated 29.11.2008, on merits within the time as fixed by this Court.

O R D E R
Heard Mr.R.Baskaradoss, learned counsel appearing for the petitioner and Mr.P.Sanjay Gandhi, learned Additional Government Pleader appearing on behalf of the respondents.
2. By consent of the parties the Writ Petition is taken up for final disposal.
3. The learned counsel for the petitioner has submitted that the petitioner was awarded punishment of stoppage of increment for one year with cumulative effect in the proceedings of the second respondent made in Na.Ka.29129/2008/A4, dated 29.11.2008. The petitioner preferred statutory appeal to the first respondent on 30.12.2008, through proper channel in person. Subsequently, the petitioner made a reminder representations through proper channel on 09.02.2012, 28.01.2014 and 24.12.2016. Since the petitioner is due to retire on the afternoon of 28.02.2017, the petitioner has filed this Writ Petition to direct the first respondent to dispose the statutory appeal preferred by him.
4. The learned Additional Government Pleader appearing for the respondents has submitted that if the said application is pending, the first respondent will consider the representation on merits and in accordance with law.
5. In view of the submission of the counsel for both sides, this Court is inclined to direct the first respondent to consider petitioner's statutory appeal dated 30.12.2018 and pass orders, on merits and in accordance with law as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above observations and directions, the Writ Petition is disposed of. No Costs.
