Common Order:
CCCA.No.17 of 2012 arises out of judgment and decree, dated 29-09-2011, in OS.No.63 of 2009 on the file of the Court of the learned XIV Additional Chief Judge, City Civil Court, Hyderabad.
Both the parties have filed CCCAMP.No.229 of 2014 to record the compromise in terms of the Memorandum of Compromises, dated 14-02-2013, annexed thereto.
On behalf of the appellant- Company, Mr.T.Venkatramana, the Deputy General Manager (Operations), filed an affidavit wherein he has inter alia stated that after the filing of the appeal, the dispute was amicably settled between the parties and that the settlement was reduced into writing by way of Memorandum of Compromise, dated 14-02- 2013, as per which the appellant has paid Rs.10,50,000/- to the respondent vide two demand drafts, dated 14-02-2013. He has, therefore, requested for recording the compromise and disposal of the appeal in terms thereof.
Along with the affidavit, the appellant has filed Memorandum of Compromise shown to have been signed by the representatives of both parties.
At the hearing, the learned Counsel as well as the representatives of both the parties are present. All of them have confirmed the fact of the dispute having been settled by entering into the abovementioned Memorandum of Compromise.
In the light of the above, the appeal is disposed of in terms of the Memorandum of compromise. The Registry is directed to draw up the decree in terms of the Memorandum of compromise.
CCCAMP.No.229 of 2014 is ordered accordingly.
As a sequel, CCCAMP.No.54 of 2012, filed by the appellant for interim relief, stands disposed of.
