JUDGMENT / ORDER

The petitioners herein are the three accused in C.C. No.895/2013 of the Judicial First Class Magistrate (Forest Offences), Nedumangad. Crime in the said case was registered under Sections 341, 323, 324, r/w 34 IPC on the complaint of one Anwar Sha. The petitioners seek orders quashing the prosecution on the ground that they and the complainant have come to terms amicably out of court. The de facto complainant Anwar Sha is the third respondent herein. He has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint. I am well satisfied that there is a real settlement, and that continuance of prosecution in such a circumstance will not serve any purpose, other than wasting the precious time of the court. In the result, this petition is allowed. The prosecution as against the petitioners in C.C 895/2013 of the Judicial First Class Magistrate Court, Nedumangad will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioners will stand released from prosecution, and the bail bond, if any, executed by them will stand discharged.
