High Court Of Gujarat|23 May, 2012

JUDGMENT / ORDER

1. Rule.
Mr. H. K. Patel, learned APP waives notice of rule on behalf of respondent no.1 - State.
2. Heard learned APP.
3. The applicant, who is convicted for 7 years, seeks temporary bail on the ground of Nikah ceremony of his real daughter, which is scheduled to be performed on 25.05.2012 and upon preliminary verification of father of the groom to be, reveals that the said marriage is scheduled on 25.05.2012. Another statement of wife of the applicant, would also reveal that the Nikah ceremony was earlier fixed on 10.05.2012, but the applicant could not secure temporary bail and therefore, it was shifted to 25.05.2012.
4. In view of the above and considering the jail record of the applicant, I am inclined to grant 15 (fifteen)days of temporary bail from the date of release to the applicant on furnishing a personal bond of Rs.2000/- (Rupees two thousand only) to the satisfaction of the jail authority on usual terms and conditions and that, on completion of the period of temporary bail, the applicant shall surrender in time.
5. The application is allowed accordingly. Rule is made absolute to the above extent.
