In spite of notice having been issued on 25.06.2012 and a last chance being granted for filing an affidavit-in-reply on 19.10.2012, no affidavit-in-reply has been filed by respondent No.2. The Court was constrained to pass an order on 05.11.2012 extending the time for filing the affidavit-in-reply upto 03.12.2012 and directing respondent No.2 to remain personally present before the Court, if the affidavit-in-reply is not filed. On 05.11.2012, the matter was adjourned to 27.12.2012. No affidavit-in-reply has been filed and neither has the Court been informed that respondent No.2 was present on 05.11.2012.
It appears that respondent No.2 is not interested in contesting the petition. If, however, respondent No.2 does decide to file an affidavit-in-reply, the same be done on, or before, the next date of hearing, failing which the petition shall be decided in the absence of the affidavit-in-reply.
