Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Amresh Singh, learned counsel for the respondent-Gaon Sabha and perused the record.
Present petition has been filed with a prayer to direct the respondent nos. 1 to 4 to remove illegal construction or possession of respondents no. 6 to 11 from plot no. 291 of Gram Sabha land of Gram Sabha Village Milak Pichauda, Pargana Richa, P.S. Nawabganj, Tehsil Bahedi, District Bareilly.
Admittedly, the representation given to the District Magistrate nowhere indicates arazi number. The petitioner has also not made any effort to approach the authority concerned under the relevant provisions of law and there is no receiving of the representation.
In such view of the matter, present PIL stands disposed of with liberty to the petitioner to approach the authority concerned first with appropriate application in accordance with law.
No order as to costs.
