Heard learned counsel for the petitioner and Sri Harsh Vardhan, who appeared for the respondents.
The petitioner was engaged in KGBV to teach the subject of Urdu. Her contractual engagement has been brought to an end with the respondents taking the decision that she did not possess the qualification as prescribed. The qualification which presently applies stands embodied in the Government Order of 17 August 2013 which provides a candidate in order to be appointed to teach that subject must have had Urdu as a subject at the graduation level. The petitioner places her case on a Government Order of 05 September 2006 which had prescribed that Urdu should have been studied as one subject in two out of the three examinations of High School, Intermediate and Graduation. That stipulation stands amended and overridden by the subsequent Government Order of 17 August 2013. The aforesaid facts have been noticed by this Court in its judgment rendered today in Suneeta Singh Vs. State of U.P. And 4 Others [Writ -A No. - 4845 of 2021. Undisputedly the qualification upon which reliance is placed by learned counsel does not meet the essential qualifications prescribed in the notification of 17 August 2013.
Accordingly and for the aforesaid reasons, the instant petition stands dismissed.
